Tax Benefits and Social Impact: How Donations Enhance Your Business Value

What are the requirements to qualify for tax benefits?

In order for cash or in-kind donations to qualify for the tax relief provided by law, in the form of a deduction from taxable income or a tax credit, they must meet a few fundamental criteria:

Eligible Beneficiary Entity

The contribution must be allocated to entities recognized by law, such as Third Sector Entities (TSEs), foundations, or registered non-profit/social purpose associations.

Tracciabilità dei versamenti

I pagamenti in denaro devono avvenire esclusivamente
tramite strumenti tracciabili (bonifico bancario o postale,
carte di credito/debito, assegni non trasferibili).
Non sono ammesse agevolazioni per donazioni in contanti.

Supporting Documentation

The company must retain proof of payment, statements issued by the receiving entity, or deeds of transfer (in the case of goods donations).

Compliance with Regulatory Limits

Benefits are calculated within maximum thresholds set by law (e.g., deductibility up to 10% of total net income pursuant to Art. 83 of the Third Sector Code).

Types of Tax-Deductible Donations for Businesses

Companies can choose from various charitable giving options, each with specific features and distinct tax benefits. It is important to identify the ideal solution that balances the company’s financial sustainability with its Corporate Social Responsibility (CSR) goals.

Monetary Donations

It is the most common and immediate form of support. They can be made as a one-off payment or on a recurring basis (e.g., periodic contributions) and grant access to the main tax benefits provided by law.

In-Kind Donations

Companies can donate products, goods, equipment, or materials. This allows businesses to unlock the value of unsold inventory or capital goods while reducing waste, providing tax benefits proportional to the value of the donated assets.

Donations for Specific Projects

Resources allocated to fund specific projects (e.g., libraries, computer labs, courses). They allow companies to directly link their contribution to causes aligned with their corporate values.

Corporate Volunteering

It consists of providing a non-profit organization with the time and professional skills of company employees during working hours. Although it does not constitute a direct financial donation, it generates high social value and is fully included in sustainability reporting.

Strategic Partnerships with Non-Profit Organizations

Structured, long-term collaborations that go beyond simple donations. They enable the creation of high-value social initiatives, strengthening corporate reputation, brand equity, and stakeholder relations.

Charitable contributions to Non-Profit Organizations (Third Sector Entities) are governed by regulations that guarantee significant tax benefits for businesses, turning social commitment into an opportunity for tax efficiency. For corporations and commercial entities (IRES taxpayers), the main incentive mechanism is the deduction from net total income. Companies can refer to two alternative tax frameworks:

  • Third Sector Code (Art. 83, paragraph 2, Legislative Decree no. 117/2017): Donations (both monetary and in-kind) made to Non-Profit Organizations (ETS) are tax-deductible from net total income up to 10% of the declared income. If the deduction exceeds total income, the excess amount may be carried forward to increase the deductible amount in subsequent tax periods, up to the fourth year.
Consolidated Law on Income Tax (Art. 100, paragraph 2, letter h, TUIR) — Alternatively, monetary contributions are tax-deductible up to a limit of €30,000 or up to 2% of the declared business income.
  • In-Depth Note: Tax credits (direct deductions from personal income tax, IRPEF) mainly apply to individuals and sole proprietorships. For corporate entities (subject to corporate income tax, IRES), the benefit applies almost exclusively as a deduction from taxable income. In any case, we recommend consulting your tax advisor to select the most advantageous tax regime based on your financial statements.
